Reasons for Child Care Plan

You will need to explain to the court why the Child Care plan you want is in the best interest of your children. If both Petitioner and Respondent agree, the reason can be something like: Petitioner and Respondent agree that this Child Care plan is in the best interest of our children.

If Petitioner and Respondent do not agree, then you should carefully detail why this Child Care plan is in the best interest of the children. The following are some examples:

Petitioner's adjusted gross income is higher than Respondent's adjusted gross income.

• Petitioner has more disposable earnings than Respondent.
• Petitioner has employer based day care.
• Petitioner does not work and is a stay at home parent.
• Petitioner works at home and can care for the children.
• Petitioner sets Petitioner's own schedule and can care for the children.

Respondent's adjusted gross income of is higher than Petitioner's adjusted gross income.

• Respondent has more disposable earnings than Petitioner.
• Respondent has employer based day care.
• Respondent does not work and is a stay at home parent.
• Respondent works at home and can care for the children.
• Respondent sets Respondent's own schedule and can care for the children.
